What is Mediation?


Mediation, as defined in Florida Statute 44.1011(2), is a process whereby a neutral third party person called a Mediator acts to encourage and facilitate the resolution of a dispute between two or more parties. It is an informal and non-adverarial process with the objective of helping the disputing parties reach a mutually acceptable and voluntary agreement. In mediation, decision making authority rests with the parties. The role of the Mediator includes, but is not limited to, assessing the parties in identifying issues, fostering joint problem solving and exploring settlement alternatives.

To be clear, mediation is an informal and non-adversarial process where the decisions reached are achieved through self-determination of the parties with facilitation assistance from a neutral and unbiased third person called the Mediator.


When is Mediation Right for You?


Pre-suit Mediation

Save the expense and delays of filing a lawsite, if the two parties to a dispute can agree to have their dispute mediated by a qualified mediator. Pre-suit Mediation can save money and achieve a resolution to the dispute much sooner than is possible with the crowded court dockets of today. Also Florida Statutes now require that mediation be attempted prior to being eligible to file suit in certain real property disputes.                        

Court Ordered Mediation 

Most courts today are faced with full court dockets which mean that resolutions of many civil disputes will not be resolved for months. Judges recognize that many disputes can be resolved through mediation; accordingly judges are recommending or ordering many civil cases to mediation prior to scheduling a trial date. Generally a judge will allow parties approximately 10 days to select a mutually agreeable mediator; if the parties are unable to make a mutually agreeable selection, the court will assign a mediator to hear the dispute.                      

Mediation Clauses in Agreements

Recognizing that mediation is a time and cost efficient method of resolving disputes, many attorneys ad businesses today are placing mediation clauses in all of their agreements and contracts. These mediation clauses require that when there is a dispte concerning the agreement of contract the parties are required to make a good faith attempt to mediate the issue prior to filing suit.
